Janta Party President files PIL in SC seeking cancellation of FIPB nod to AirAsia India

Subramanian Swamy, President, Janta Party has challenged the proposed Joint Venture (JV) between AirAsia Berhad, Tata Sons Ltd and Arun Bhatia of Telestra Tradeplace Pvt. Ltd., AirAsia India, in the Supreme Court of India (SC), as per a Business Standard report. In a 60-page Public-Interest Litigation (PIL), he has sought cancellation of the Foreign Investment Promotion Board?s (FIPB) clearance to the airline. The matter will be discussed in the SC on Monday.

Swamy argues illegalities in the deal and that on the back of pressure from the Ministry of Commerce and Industry, the Ministry of Civil Aviation decided not to push its contention on allowing Foreign Direct Investment (FDI) in new JVs. In March, the FIPB cleared a proposal to launch the airline.

West Va teachers ballistic over teacher dress code | The Daily Caller

The last time The Daily Caller?s education section checked in on West Virginia, police in Logan County had arrested an eighth-grader over an NRA shirt and the kid was facing a year in jail. (RELATED: Charges dropped against 8th-grader who wore NRA shirt)

Now, teachers a few counties over are pitching a fit because the local board of education voted to prohibit them from wearing blue jeans, faded jeans and shorts to work.

The Lewis County Board of Education?s vote at a Monday board meeting?in favor of the ban was unanimous, reports WBOY-TV.

The ban has been a highly rancorous issue in the rural county for some time now.

Board president Paul Derico suggested that residents weren?t happy with the way teachers have been presenting themselves in classrooms.

?We?ve had a lot of comments, or at least I have personally, and that comment is, ?I?m glad you board members are finally doing something about the way the teachers dress,?? Derico told WBOY.

However, many of the teachers affected are deeply unhappy.

?I?m very disappointed. I think I give 200 percent of myself for this county, and I don?t feel like they have given me any respect back,? teacher Carmen Shafer protested. ?They said they?re doing this to protect us from the few people that didn?t follow the dress code. As far as I?m concerned, and from my understanding, blue jeans was never involved in that. So I don?t understand why they are taking away the blue jeans.?

Like many other teachers, Shafer wore a blue t-shirt and jeans to Monday?s board meeting.

An attorney from the American Federation of Teachers, Jeff Blaydes, indicated that the union may sue so that public school teachers will have the right to wear shorts and faded jeans as they teach students.

?We?re disappointed in the actions of the board,? Blaydes told CBS affiliate WDTV. ?We don?t believe it?s in the best interest of the teachers of Lewis County. We think it?s inconsistent with their statutory and constitutional rights. We?re going to explore all of our legal actions when we get back and take the next steps appropriate.?

According to MetroNews, former West Virginia Education Association President Tom Lange argued that teachers shouldn?t have to make weighty considerations about what?s on their legs each day.

?It?s pretty tough to enforce and just another thing on people?s plates that they?ve got to try to deal with and they?ve got enough stuff to deal with and worry about,? Lange said.

New allegation against San Diego mayor

A former campaign staffer for San Diego Mayor Bob Filner became the second woman to publicly accuse him of sexual harassment, saying Tuesday that the then-congressman patted her "posterior" while at a fundraising event.

Laura Fink, who now runs a political consulting firm, told KPBS-TV that it happened in 2005 when she was working as Filner's deputy campaign manager.

Fink said she didn't go public with the incident at the time because she was trying to build her political career. But she said she now feels emboldened to tell her story after Filner's former spokeswoman, Irene McCormack Jackson, sued him for sexual harassment Monday.

Jackson said Filner subjected her and other women to "crude and disgusting" comments and inappropriate touching. She said she resigned as Filner's communications director in June after deciding the mayor would not change his behavior.

"I had to work and do my job in an atmosphere where women were viewed by Mayor Filner as sexual objects or stupid idiots," Jackson said. She said Filner asked her to work without underwear and made repeated sexual advances toward her.

"He is not fit to be mayor of our great city. He is not fit to hold any public office. A man who lacks character makes a mockery of his ideas," she said.

Fink told KPBS on Tuesday that the incident happened as she was escorting Filner from table to table at a fundraising dinner. At one point, she said, someone at the event told Filner that Fink had "worked her ass off" for him.

"He turned to me and he said, 'Turn around,' " Fink said Tuesday. "And as a staffer, I know it sounds silly to just do it, but you just do it. And so I turned around and he proceeded to take his hand and pat me on my posterior and laugh and say, 'No, it's still there.' "

Fink gave the station a copy of an e-mail she sent to Filner in which she asked for an apology. A few days later, KPBS reported, Filner mumbled "I'm sorry" but told her she didn't understand what happened.

Filner has been battling allegations of sexual harassment for several weeks, but none of the women leveling those claims came forward before Jackson filed her suit in state court. Her lawyer, Gloria Allred, called on Filner to resign, telling reporters, "Apologies alone will not take care of this injustice."

Officials: Zimmerman helped 4 out of wrecked SUV

ORLANDO, Fla. (AP) ? George Zimmerman helped rescue four people from an overturned vehicle in central Florida last week, just days after he was cleared of all charges in the shooting death of Trayvon Martin, officials said Monday.

Seminole County Sheriff's spokeswoman Kim Cannaday said in a statement that deputies responding last Wednesday afternoon to the wreck in Sanford ? the Orlando suburb where Martin was shot ? found Zimmerman and another man had already helped a couple and their two children out of a flipped SUV off the road near Interstate 4. They were not hurt.

Zimmerman spoke with a deputy at the scene and then left, the sheriff's office statement said. He did not see the crash happen.

This is believed to be the first time Zimmerman, 29, has been seen publicly since his acquittal on a second-degree murder charge in the 17-year-old Martin's death in February 2012. Zimmerman's parents and his attorneys have said in interviews since the verdict that they fear for his safety because of those who may not agree with it.

A message left at the office of Zimmerman attorney Mark O'Mara was not immediately returned Monday.

Robert Zimmerman, Jr. on Monday posted on his Twitter account about his brother's actions: "George saw a need, he acted. Our parents taught us to help, never to boast. Humility is George's finest trait."

Martin's shooting death spurred debate across the U.S. over racial profiling, self-defense and equal justice. Protesters nationwide lashed out against police in Sanford because it took 44 days for Zimmerman, a neighborhood watch volunteer, to be arrested last year. Many, including Martin's parents, said Zimmerman had racially profiled the unarmed black teen. Zimmerman, who identifies himself as Hispanic, said he acted in self-defense during a fight with Martin.

Six female jurors, whose names have not been released, considered nearly three weeks of often wildly conflicting testimony over who was the aggressor on the rainy night Martin was shot while walking through the gated townhouse community where he was staying and where Zimmerman lived.

The acquittal prompted rallies nationwide in the days afterward calling for a civil rights investigation and federal charges against Zimmerman.

It also led to a sit-in at Florida Gov. Rick Scott's office demanding that legislators repeal the state's stand-your-ground self-defense law. The law, passed in 2005, generally eliminated a person's duty to retreat in the face of a serious physical threat. At least 21 states have a self-defense law similar to Florida's.

It's a boy! UK's Kate gives birth to royal heir

LONDON (AP) ? It's a boy!

Prince William's wife, Kate, has given birth to a prince who is now third in line to the British throne.

The child was born Monday afternoon, after many Britons woke up to the news that Kate, also known as the Duchess of Cambridge, had gone into labor with the couple's first child.

The royal birth announcement said the boy was born at 4:24 p.m. weighing 8 pounds, 6 ounces. William was present for the birth, the statement said. The announcement did not include a name for the future monarch, though one is expected to be revealed in the coming days.

"Her Royal Highness and her child are both doing well and will remain in hospital overnight," it said. William also issued a brief statement, saying "we could not be happier."

Cries of joy erupted from the waiting crowd amassed near Buckingham Palace as the news came through, and hundreds of onlookers ? some of whom had camped outside for hours ? crushed against the palace's fences to catch a glimpse of the bulletin formally announcing the birth placed outside the palace's forecourt.

"It's a crazy atmosphere, everyone is getting very excited," said Andrew Aitchison, 47, outside the palace. "It's great to be part of history, to say we were here and saw it all happen."

William's father, Charles, and his wife, Camilla, spoke of their joy and pride in becoming grandparents for the first time.

"It is an incredibly special moment for William and Catherine and we are so thrilled for them on the birth of their baby boy," Prince Charles said in a statement. "Grandparenthood is a unique moment in anyone's life, as countless kind people have told me in recent months, so I am enormously proud and happy to be a grandfather for the first time and we are eagerly looking forward to seeing the baby in the near future."

It could be some time before the baby's name is made public. When William was born, a week passed before his name was announced. Charles's name remained a mystery for an entire month.

The royal birth at central London's St. Mary's Hospital recalled that of the baby's father, William, in 1982, at the same hospital. Many remember the moment when he was carried out in his mother Princess Diana's arms with proud father Prince Charles at their side.

William and Kate's son is expected to follow Charles and William to the throne.

The baby's gender had been of particular interest because the prospect of Kate's pregnancy had prompted a change to laws of succession to ensure that a daughter would not be passed over for the crown by a younger brother.

No one can tell what political and personal changes the intervening years will bring, but the baby can be expected to become the head of state of 16 countries, including Britain, Australia and Canada. The child will also eventually become Supreme Governor of the Church of England.

The little prince represents a living link to Britain's imperial history ? the infant is the great-great-great-great-great-grandchild of Queen Victoria, who ruled at the peak of British power.

The couple waited, however, until William was nearly finished with his military work as a search and rescue helicopter pilot based at an air base in a remote island off the coast of Wales.

That allowed Kate to ease into royal life, and to become more comfortable in the spotlight, before becoming a parent. It also allowed her to play a supporting role during Queen Elizabeth II's Diamond Jubilee celebrations last summer.

The first months of her pregnancy were not easy, and she was hospitalized in early December with acute morning sickness that left her weak and dehydrated. She seemed to recover her stamina fairly quickly and made a series of public appearances until the final weeks before giving birth, drawing praise for her poise and good cheer.

The royal couple and their newborn are expected to spend much of their time in the coming years in renovated quarters at Kensington Palace, where William and Harry also spent much of their childhood.

Royal officials say Kate and William will try to give their child as normal an upbringing as possible. That may be challenging in an age when the British royals are treated as major world celebrities.

Hey Facebook, What About Our Privacy?

Facebook has recently launched its graphic tools and this is exposing user's weak privacy settings spilling their content unwittingly back into the public domain. This article discussed Facebook's attitude to user privacy and how users react.

Grace Hopper once wrote that is was ?easier to ask for forgiveness than it is to get permission.? This seems to me to be the corporate mantra of Facebook Inc. And they've done it again with their new graphing feature.

When Facebook really started to take off back in the early 2000s privacy wasn't a concern or issue to either users or providers. This new style of sharing became the new normal and people were happy to post all sorts of private content on the web. That was until they figured out that everyone, stalkers and all, could gawk at their privates.

It took Facebook a long time to segment users into categories and there was a major obstacle to present some sort of security settings based on each group. The forced capitulation was quite simple ? user group pressure. Early Facebookers were the Millennials. They quickly worked out, after a few embarrassing moments, that they didn't want mom and dad to see the same postings, pictures and comments that they shared with their other 20-something friends or of greater severity where employers have terminated users based on their Facebooks postings. This was an obvious and necessary evolution.

Users then became quite adept as closing down their profiles so their admirers, strangers and prospective employers couldn't have a window into their life. But Facebook made this intentionally cumbersome and difficult to use and security around groups even more so. It's easy to understand Facebook's reluctance. Stalking, browsing and just glimpsing into friends of friends or voyeuristic peeks into total random strangers was not only fun, but keeping active users on the site.

But here's the thing Facebook, users always win ? always !! Internet users today are much much more savvy, particular and picky about where their content goes. Instagram, owned by Facebook, tried to dupe it's user with a bait & switch on it's terms of use, remember who won ? Those young Facebook users have already all but abandoned their profiles. They are using things like snapchat ? which protects your digitals. Even sharing one on one, they are ensuring those shared moments are just that, about 3 seconds. This is the new shelf life of openness and sharing.

It seems though that Facebook has learned nothing.

The recent introduction of its graphing tool is a throwback to the days of cyber-stalking. Content that users thought was private is all of a sudden searched and mined and available for all to consume. The user can shut this down through a myriad web of intricate security settings, but most are at this point completely oblivious. Wait until they find out.

It's not that Facebook is some Orwellian, terrible organization that is hated by all. On the contrary, Facebook has served as an incredible platform to connect the globe in a way that no other has yet managed to come even close to. But Facebook is so fixated on it's lackluster share price performance that it's forgetting who its core is ? its users. I'm not sure something is coming along to usurp Facebook, like Google+ or a revived MySpace, but I can tell you that users are going to start parking their content somewhere else, somewhere safe and they're going to ask for neither permission nor forgiveness.

Miles: Jeremy Hill remains indefinitely suspended

HOOVER, Ala. (AP) ? The LSU Tigers don't seem too concerned by the uncertainty of this offseason.

Coach Les Miles said Thursday that running back Jeremy Hill, last year's leading rusher, remains indefinitely suspended after being formally charged Monday with misdemeanor simple battery from a late April fight in a bar parking lot.

Meanwhile, the Tigers were picked to win the Southeastern Conference on only one of 243 media ballots released shortly before their SEC media days appearance. They're forecast to finish behind Alabama and Texas A&M in the West.

"Everybody usually enjoys being an underdog," quarterback Zach Mettenberger said. "I guess it gives them extra incentive to practice harder and play harder. But we are a team that could care less what the rankings are, especially in the preseason. It means absolutely nothing."

The Tigers lost to the Crimson Tide on a last-minute touchdown and beat the Aggies 24-19 last season.

Mettenberger also isn't sweating the possibility of playing without Hill for several games or even the season.

Miles said Hill has not been allowed in the football facility or to participate in team meetings or workouts this summer. He's waiting for resolution of the case before deciding on Hill's fate with the team.

"We've visited with Jeremy Hill on a routine basis," Miles said. "It's been very hard on him, I know.

"We recognize that there's an ongoing process that's going to be fulfilled. We're going to sit on the perimeter and watch. We certainly are respectful of all that have responsibility there."

Hill was already on probation after his January 2012 guilty plea to a misdemeanor stemming from his sexual relationship with a then-14-year-old girl at his high school. A state judge has put Hill under a daily curfew from 9 p.m. to 6 a.m.

He ran for 755 yards and 12 touchdowns as a freshman. The Tigers won't be short on talent in the backfield even without Hill. Alfred Blue had 270 yards in three games before going down with a season-ending knee injury, and Kenny Hilliard has 800 yards and 14 touchdowns in two seasons.

"What happened to Jeremy is terrible and we wish all the best for him," Mettenberger said. "But if Alfred Blue didn't get hurt last year, a lot of people wouldn't know who Jeremy Hill was. He was put in a place where he had to play last year young, and he played very well.

"But having Alfred back and him being a senior, showing what he's capable of doing, is something that I'm going to enjoy watching him."

Running back Spencer Ware was among the school-record nine draft picks ? and 11 early departures ? including first-rounders Barkevious Mingo and Eric Reid. Safety Craig Loston thinks all those highly ranked recruiting classes leave LSU in good shape.

"I think we'll be fine," Loston said. "We always lose a couple of players to the NFL. We just keep rebuilding, and that's the thing about LSU. They recruit guys that can get the job done."

Japan team wraps up USDA meeting on GM wheat situation

WASHINGTON | Wed Jul 17, 2013 10:59pm BST

WASHINGTON (Reuters) - A Japanese delegation is completing talks with the U.S. Department of Agriculture aimed at restarting purchases of U.S. western white wheat, which were halted after the discovery of an unapproved genetically modified strain growing in Oregon.

"USDA is hosting a team from Japan's Ministry of Agriculture, Forestry and Fisheries for technical discussions in support of the resumption of trade of U.S. western wheat," a USDA spokesman told Reuters.

Official talks are due to end on Wednesday, but the Japanese team will be in the United States until Saturday, USDA said, adding that it does not plan to provide further details.

U.S. merchants said a pickup in Asian demand helped the western white wheat market to gain this week, with prices higher at the Chicago Board of Trade. South Korea lifted its ban on U.S. imports this month, and Indonesia was a buyer, leaving Japan as the major holdout.

Japan, one of the world's largest and most consistent importers of wheat, has shunned the western white variety since USDA announced the GM discovery in late May.

Western white is the wheat variety used in Japan for cakes, cookies and other baked goods.

The Japanese delegation was expected to lay out in detail what they want to happen in the United States in order for imports of western white wheat to restart.

Japan wants USDA to test a composite sample of each western white shipment, and give shippers a letter that certifies the shipment has no GM wheat. Samples would also be sent to Japan for testing there, ahead of the arrival of vessels from the United States, according to industry officials there.

Reuters reported on July 8 that Japan hopes to restart the white wheat purchases as soon as August.

Japan continues to purchase other varieties of U.S. wheat at its regular tenders.

But its buyers are said to be eager to get the white wheat supply pipeline filled again before the peak import season in October and November, and to have enough flour on hand to bake the white cakes many Japanese traditionally eat at Christmas.

The wheat found in Oregon was a strain developed by Monsanto Co but never commercially available. Monsanto abandoned its GM wheat field trials in 2005, but stored the unapproved wheat in a Colorado facility at least until late 2011.

After a weeks-long investigation, USDA termed the Oregon wheat discovery "a single isolated incident" and said there was no indication so far that any biotech wheat was in the U.S. food chain.

White House: 'Yeah,' Olympics boycott would be a bad idea

The White House grudgingly acknowledged on Wednesday that boycotting the 2014 Olympics in Sochi, Russia, to protest Moscow?s sheltering of NSA leaker Edward Snowden would be a bad idea.

It?s not (or at least not just) a silly, media-stoked Beltway debate. The U.S. has been trying to escalate pressure on Russia to turn over Snowden, who faces felony charges tied to his disclosure of how the government collects the telephone and Internet records of millions of Americans.

Republican South Carolina Sen. Lindsey Graham has urged President Barack Obama to consider boycotting the upcoming games in response.

Republican House Speaker John Boehner slapped the idea down sharply. But he doesn't speak for the president. So what did White House press secretary Jay Carney have to say?

?Our view is that we?re continuing to work with the Russian government and other nations on this matter, and we hope to see Mr. Snowden return to the United States,? Carney replied to the first of maybe five or six questions about a possible boycott.

But what about Graham?s suggestion?

?I?m not going to engage in speculation about that, and the Olympics are a long way off,? Carney said. ?We believe that we have a strong case and we have made that case to Russia.?

He added, ?We don?t want this matter to do harm to our bilateral relations. We have a very important and broad relationship with Russia that encompasses a great many areas of cooperation, as well as some areas of disagreement. ... This does not need to?and should not?do any harm to those relations.?

OK, so an Olympics boycott is not on the table?

?I didn?t suggest it was,? said Carney, who also had not suggested it wasn?t. ?I think speculation about, you know, what might happen if it's not resolved is certainly not helpful.?

The U.S. last shunned the games in 1980 in response to the Soviet invasion of Afghanistan the previous year, one reporter noted. Surely the Snowden affair doesn?t rise to that level?

?I would refer you to the senator who, you know, sort of threw out that suggestion,? Carney said. ?We?re focused on trying to resolve this matter in a way that is in the interest of the United States and in the interest of U.S.-Russian relations.? (Note: Carney was still not explicitly saying that an Olympics boycott would be a bad idea, much less ruling one out.)

A few questions later, another reporter followed up on the Olympics issue.

?You guys aren?t jumping to a superficial headline, are you?? Carney asked with a slight grin.

Can we conclude that the president thinks it would be a bad idea to boycott the Olympics?

?Come on,? Carney said. ?A lawmaker put it out there. We?re not focused on that.?

So it?s a bad idea, right, the reporter asked.

?Yeah,? Carney said, finally. ?But it?s not one that is an issue right now, because we?re engaged with the Russians and other governments in helping bring about a positive resolution to this matter."

Barclays pledges to fight US energy fine

LONDON (AP) ? Barclays has vowed to fight a fine by U.S. regulators, who allege the bank manipulated the electricity prices in California and other western states to make money off of trades.

American regulators on Tuesday ordered the U.K.-based bank and four of its traders to pay $453 million in civil penalties for manipulating electricity prices between November 2006 and December 2008.

The Federal Energy Regulatory Commission also ordered Barclays to pay $34.9 million, plus interest, for what it described as "unjust profits" to low income energy assistance programs in Arizona, California, Oregon and Washington.

The allegations will mark a fresh blow to the scandal-shaken bank, whose new chief executive, Antony Jenkins, has made a point of saying that ethics matter as much to Barclays as the bottom line. The lender has faced a string of scandals costing it billions of pounds (dollars), and was fined by regulators in the U.S. and Britain for manipulating the London interbank offered rate, or LIBOR, the benchmark for trillions of dollars in loans ? including some home mortgages.

Investors did not seem worried, however, with Barclays' share price trading up 0.9 percent at 311 pence on Wednesday.

The statement by U.S. regulators said that Barclays and the four traders ? Daniel Brin, Scott Connelly, Karen Levine and Ryan Smith ? took part in an "affirmative, coordinated and intentional effort to carry out a manipulative scheme."

Regulators said the fines stemmed from "the seriousness of the violations and the lack of any effort by Barclays and the traders to remedy their violations."

Barclays contests what it described as a one-sided statement, arguing that it strongly disagreed with a FERC assessment "that does not reflect a balanced and full description of the facts or the applicable legal standard."

"We intend to vigorously defend this matter," the bank said in a statement Tuesday.

FERC gave Barclays 30 days to pay the penalties.

If the bank declines to pay the fine, FERC said it could "seek affirmation," from a federal district court.
